TERMS AND SERVICE:

 

1. BINDING: This is a binding agreement. By using the Internet site located at https://jefes-airsoft-solutions.myshopify.com and https://jefesairsoftsolutions.com/ (the "Site") or any services and/or products provided in connection with or via the usage of the Site (the "Services/Products"), you agree to abide by these Terms of Service, as they may be amended by Jefe's Airsoft Solutions ("The Company") from time to time at its sole discretion. The Company may or may not post a notice on the Site any time these Terms of Service have been changed or otherwise updated, but the Terms of Service currently published on the Site will always be considered currently in effect and enforceable. It is your responsibility to review these Terms of Service periodically, and if at any time you find these Terms of Service unacceptable, you must immediately leave the Site and cease all use of the Services/Products and the Site.

 

YOU AGREE THAT BY USING THE SITE YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.

 

1. PRIVACY POLICY: Find it here The company respects your privacy and permits you to control the treatment of your personal information. The company's privacy policy is expressly incorporated into this Agreement by this reference.

 

When you are required to open an account to use or access the Site or Service, you must complete the registration process by providing the complete and accurate information requested on the registration form. You will also be asked to provide an e-mail and password. You are entirely responsible for maintaining the confidentiality of your password. You may not use the account, username, or password of someone else at any time. You agree to notify the Company immediately of any unauthorized use of your account, username, or password. The Company shall not be liable for any loss that you incur as a result of someone else using your password, either with or without your knowledge. It is possible, that you may be held liable for any losses incurred by the Company, its affiliates, officers, directors, employees, consultants, agents, and representatives due to someone else's use of your account or password, so you should always maintain exclusive use and complete privacy of your username and password.

 

1. USE OF SOFTWARE: The Company may make certain software available to you from the Site. If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying data (collectively, "Software") are deemed to be licensed to you by the Company, for your personal, noncommercial, home use only. The Company does not transfer either the title or the Intellectual Property rights to the Software, and the Company retains full and complete title to the Software as well as all Intellectual Property rights therein. You may not sell, redistribute, or reproduce the Software, nor may you decompile, reverse-engineer, disassemble or otherwise convert the Software to a human-perceivable form. All trademarks and logos are owned by the Company or its licensors and you may not copy or use them in any manner.

 

1. USER CONTENT: You agree to transfer ownership of any materials or information to the Company that you post to the Site and/or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content ("User Content") to the Site or Service, you are granting the Company, its affiliates, officers, directors, employees, consultants, agents, and representatives FULL OWNERSHIP of any and all User Content and agree that the Company may use said User Content in any way it deems necessary or beneficial to the Company, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat User Content in perpetuity. You further agree that you will not be compensated for any User Content. You agree that the Company may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.

 

1. COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS: When accessing the Site or using its Services/Products, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Site and/or Services/Products is at all times governed by and subject to laws regarding copyright ownership and use of the intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content (collectively, "Content") in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third-party rights caused by any Content you provide or transmit, or that is provided or transmitted using your User ID or e-mail. The burden of proving that any Content does not violate any laws or third-party rights rests solely with you.

 

1. INAPPROPRIATE CONTENT: You are not permitted to make the following types of Content available on the Site or any related Database, Message Board, Forum, etc. You agree not to upload, download, display, perform, transmit, or otherwise distribute any Content that (a) is libelous, defamatory, obscene, pornographic, abusive, or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, federal, or international laws and/or regulations; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. The company reserves the right to terminate your receipt, transmission, or other distribution of any such material using the Services/Products, and, if applicable, to delete any such material from its servers. The Company intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Services or of any applicable laws.

 

1. COPYRIGHT INFRINGEMENT: The Company has in place certain legally mandated procedures regarding allegations of copyright infringement occurring on the Site or with our Services/Products. The Company has adopted a policy that provides for the immediate suspension and/or termination of any Site or Service user who is found to have infringed on the rights of the Company or of a third-party, or otherwise violated any Intellectual Property laws or regulations. The company's policy is to investigate any allegations of copyright infringement brought to its attention. If you have evidence, know, or have a good faith belief that your rights or the rights of a third-party have been violated and you want the Company to delete, edit, or disable the material in question, you must provide the Company with all of the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (c) identification of the material that is claimed to be infringed or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material; (d) information reasonably sufficient to permit the Company to contact you, such as an address, telephone number, and if available, an electronic mail address at which you may be contacted; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. For this notification to be effective, you must contact the Company at info@jefesairsoftsolutions.com. Again, when contacting us, please be sure to provide us with your exact email address, name, address, and/or telephone number(s) in order to ensure a quick and effective response to your request.

 

1. SITE USAGE VIOLATIONS: The Company reserves the right to terminate your use of the Service and/or the Site. To ensure that Company provides a high-quality experience for you and for other users of the Site and the Service, you agree that Company or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third-party rights, or other unauthorized uses of the Site or the Service. The Company does not intend to disclose the existence or occurrence of such an investigation unless required by law. The Company reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if the Company believes that you have violated any of the Terms of Service, furnished the Company with false or misleading information, or interfered with the use of the Site or the Service by others, or in any way violated local, federal, or international law and/or regulations.

 

1. NO WARRANTIES RELATED TO THE SITE: THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES REGARDING THE SITE. THE COMPANY IS MAKING THE SITE AVAILABLE "AS IS" WITHOUT A WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SITE OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

 

1. PRODUCT WARRANTIES: UNLESS OTHERWISE SPECIFIED, ALL PRODUCTS SOLD ON THE SITE CARRY A 45 DAY WARRANTY. THE WARRANTY PERIOD IS EFFECTIVE FROM THE DATE YOUR PACKAGE IS SHIPPED. THE WARRANTY COVERS REPLACEMENT OR REPAIR OF DEFECTIVE AND DAMAGED PRODUCTS ONLY, SUBJECT TO THE EVALUATION AND DETERMINATION OF JEFE'S AIRSOFT SOLUTION' TECHNICIANS OR RMA REPRESENTATIVES. ALL OTHER RETURNS OR EXCHANGES ARE SUBJECT TO RESTOCKING AND SHIPPING FEES. DISASSEMBLING, ABUSING, MODIFYING, ALTERING, REMOVING, OR REPLACING THE ORANGE TIP ON AIRSOFT REPLICAS WILL VOID ALL WARRANTIES AND COULD RESULT IN A VIOLATION OF STATE AND/OR FEDERAL LAWS. THE WARRANTY DOES NOT COVER ANY PRODUCTS THAT HAVE BEEN ABUSED, DISASSEMBLED, MODIFIED, ALTERED, OR RETURNED WITHOUT THE ORIGINAL PACKAGING.

 

THE WARRANTY DOES NOT COVER BATTERIES, CHARGERS, SHOES, AND IMPORTED AIRSOFT DEVICES UNDER $100.00. JEFE'S AIRSOFT SOLUTIONS IS NOT RESPONSIBLE FOR COMPATIBILITY BETWEEN VARIOUS MANUFACTURERS' PRODUCTS, AND THE INTERNAL UPGRADE OR REPLACEMENT PARTS. ANY USE OF LOW-GRADE OR LOW-WEIGHT BB WILL VOID THE WARRANTY.

 

ALL REPAIRS AND UPGRADES COMPLETED BY JEFE'S AIRSOFT SOLUTIONS CARRY A LIMITED 45-DAY WARRANTY. THE WARRANTY DOES NOT GUARANTEE OR COVER THE OPERATION OF DEVICES WITH A SPRING RATING HIGHER THAN M120 OR ITS EQUIVALENT, OR ANY DEVICE SHOOTING OVER 400FPS WITH A 0.20 GRAM BB. THE WARRANTY DOES NOT COVER LITHIUM POLYMER (LI-POLY) BATTERY USAGE OR THE USAGE OF ANY OTHER POWER SOURCE WITH AN OUTPUT GREATER THAN 9.6 VOLTS ON AN ELECTRIC DEVICE THAT IS NOT RATED FOR SUCH USE BY ITS ORIGINAL MANUFACTURER. THE WARRANTY DOES NOT COVER ANY AIRSOFT PRODUCT OR DEVICE THAT USES HIGHER PRESSURED GAS THAN LIQUID PROPANE 9GREEN GAS, 115 PSI). THE USAGE OF ANY BB LESS THAN 0.20 GRAMS OR OF A LESSER QUALITY THAN THE MATRIX BRAND, IN ANY AIRSOFT PRODUCT, WILL VOID THE JEFE'S AIRSOFT SOLUTIONS WARRANTY.

 

THIS WARRANTY DOES NOT COVER PRODUCTS THAT ARE NOT PURCHASED FROM THE SITE.

 

FOR INTERNATIONAL ORDERS, ALL SALES ARE FINAL, WITHOUT EXCEPTION. DUE TO TRANSIT LIMITATIONS, TECHNICAL SUPPORT AND LIMITED REPLACEMENT PARTS ARE ONLY AVAILABLE FOR PRODUCTS WHERE THE DEFECT IS REPORTED WITHIN 14 DAYS OF SHIPMENT. COMPLIMENTARY REPAIR SERVICES MAY BE OFFERED WITHIN 45 DAYS OF SHIPMENT IF YOU AGREE TO BEAR THE EXPENSE OF ALL SHIPMENTS RELATED TO LOST PACKAGES, CUSTOMS SEIZURES, AND ANY OTHER UNFORESEEN CIRCUMSTANCE AS A RESULT OF INTERNATIONAL SHIPPING AND RECEIVING. 

 

1. RETURN POLICY: If you purchased an item from Jefe's Airsoft Solutions in the last 45 calendar days and are experiencing problems with the product, the Company offers a 45-day warranty to replace and repair your item (at our sole discretion) subject to the terms outlined in Section 10 of these Terms of Service. If your package arrived damaged, please inspect, keep all contents and contact our Support Team immediately. Though we are NOT responsible for damage incurred during transit, we will assist you in completing a damage claim with the carrier.

 

Please note that your package may be refused or lost in transit without prompt paperwork, which the Company is not responsible for. Also, note that a 15% restocking fee will be accessed for your return.

 

DAMAGES UPON ARRIVAL - As noted, if your package arrived damaged, one of the Customer Service Representatives for the Company will assist you in filing a claim with the carrier. Please inspect all contents and keep the original box and packaging material. Please note that this process may take up to 10 business days depending on the carrier.

 

EXCHANGES - Due to the nature of our products and services, exchanges are NOT an option.

 

RETURN FOR SITE CREDIT - You may return an item for merchandise credit if the item is unused, unworn, and unopen in its original packaging within 45 days of delivery. A 15% restocking fee will apply. Any shipping costs incurred by the Company as a result of your return will be deducted from any refund due.

 

NON-WARRANTY REPAIR/ UPGRADE SERVICES – Should you need assistance with any non-warranty repairs and/or upgrade services, the labor rate for our technicians is $45.00 an hour. All Jefe's Airsoft Solutions technicians are very experienced with repair services.

 

1. RECOMMENDATIONS: For the best use of Jefe's Airsoft Solutions products, please use high-grade Airsoft BBs sold by equivalent brands 0.2g or higher. Any use of low-grade or low-weight BBs may cause extensive damage to your device. Additionally, Jefe's Airsoft Solutions recommends the use of high-quality batteries and smart chargers. Failure to follow these recommendations will result in voiding any and all warranties and/or guarantees.

 

1. LIMITED LIABILITY: THE COMPANY'S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS, PRODUCTS, OR SERVICES PROVIDED TO YOU BY THE COMPANY. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

 

1. AFFILIATED SITES: The Company has no control over, and no liability for any third-party websites or materials. The company works with several partners and affiliates whose Internet sites may be linked with the Site. Because neither the Company nor the Site has control over the content and performance of these partner and affiliate sites, the Company makes no guarantees about the accuracy, timeliness, content, or quality of the information provided by such sites, and the Company assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that the Company makes no guarantees about, and assumes no responsibility for, the accuracy, timeliness, content, or quality of this third-party content, and that, unless expressly provided otherwise, these Terms of Service shall govern your use of any and all third-party content.

 

1. PROHIBITED USES: The Company imposes certain restrictions on your permissible use of the Site and the Products/Services. You are prohibited from violating or attempting to violate any security features of the Site or Products/Service, including, without limitation, (a) accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of the Service, the Site, or any associated system or network, or to breach security or authentication measures without proper authorization; (c) interfering or attempting to interfere with service to any user, host, or network, including, without limitation, by means of submitting a virus to the Site or Service, overloading, "flooding," "spamming," "mail bombing," or "crashing;" (d) using the Site or Service to send unsolicited e-mail, including, without limitation, promotions, or advertisements for products or services; (e) forging any TCP/IP packet header or any part of the header information in any e-mail or in any posting using the Service; or (f) attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by the Company in providing the Site or Products/Services. Any violation of system or network security may subject you to civil and/or criminal liability.

 

1. INDEMNITY: You agree to indemnify the Company for any acts and/or omissions of yours or the Company. You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site or its Services/Products, your violation of these Terms of Service, or your infringement, or infringement by any other user on your account, of any intellectual property or another right of any person or entity. The company will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

 

1. COPYRIGHT: All Intellectual Property and Data contained within the Site is considered to be protected and external use is denied, unless granted by the Company in writing, prior to any use.

 

1. GOVERNING LAW: These Terms of Service shall be construed in accordance with and governed by the laws of the United States and the State of Florida, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Boca Raton, Florida in all disputes arising out of or related to the use of the Site or Services and/or Products.

 

1. SEVERABILITY: If for whatever reason, a court of competent jurisdiction finds any term or condition in these Terms of Service to be unenforceable, all other terms and conditions will remain unaffected and in full force and effect.

 

1. WAIVER: No waiver of any breach of any provision of these Terms of Service shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party, the Company.

 

1. NO LICENSE: Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, logos, or other Intellectual Property owned by the Company or by any third party.

 

1. MODIFICATIONS TO TERMS OF SERVICE: The Company may, at its sole discretion and without prior notice, (a) revise these Terms of Service; (b) modify the Site and/or the Services/Products, and (c) discontinue the Site and/or Services/Products at any time without notice. The Company shall post any revision to these Terms of Service to the Site, and the revision shall be effective immediately on such posting. You agree to review these Terms of Service and other related online policies posted on the Site periodically to be aware of any revisions. You further agree that, by continuing to use or access the Site following any revision, you shall abide by and be bound by any such revision.

 

1. ORDER AND SHIPMENT POLICIES: Express orders (UPS 3day, 2day, and Next day or similar) placed before 1:00 PM EASTERN TIME are shipped the same day. If an order is received after 1:00 PM EASTERN TIME, it may not be shipped until the following business day. Domestic Ground orders are shipped within 1-3 business days (excluding weekends and holidays) of order payment processing. International orders require an additional 3-5 business days to ship due to additional compliance requirements and preparations.

 

In the event of an item being on Back Order or Pre-Order status, your order may be fulfilled in two separate shipments. Subsequent shipments after the first shipment will be shipped via regular ground service. All additional expenses will be covered by Jefe's Airsoft Solutions. Your credit card is charged for the full order amount at the time of order placement. In the event of a Back Order, you can request an immediate refund.

 

Low-Value Packages may be shipped via USPS depending on package content & Delivery address (PO Box, Military Address, etc.).

 

Although delays are rare, please note that UPS does not guarantee delivery time for non-express shipping methods such as Ground.

 

Once an order is placed, the order cannot be modified. You may submit a request for a return after the order is delivered. To avoid placing a duplicate order, please DO NOT CLICK "BACK" ON YOUR BROWSER AFTER CONFIRMING THE ORDER.

 

1. COUPON/PROMOTIONAL CODE DISCLAIMER: Occasionally, and at the sole discretion of Jefe's Airsoft Solutions, coupon/promotional codes may be randomly offered to consumers. We are not responsible for any technical issues that may result from transmitting those codes. No “rain-checks” are allowed with said codes, as they are only for products that are “IN STOCK”. Only one coupon code can be used per order. Coupon codes are NOT applicable for Mystery Boxes and MAP items and cannot be combined with any other ongoing specials or promotions. Due to the nature of and possibility of technical issues related to “online” coupon/promotional codes, Jefe’s Airsoft Solutions reserves the right to refuse to accept coupon/promotional codes at its sole discretion prior to any orders being processed. 

 

1. ACKNOWLEDGEMENT: BY ACCESSING OUR WEBSITE OR ENGAGING IN OUR PRODUCT/SERVICE OFFERINGS YOU ACKNOWLEDGE THAT YOU HAVE READ THE ABOVE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
